Who decides whether to settle or try my case?

ANSWER: You do. Lawyers cannot ethically settle or try cases without their clients' consent. Instead, your attorney's job is to make recommendations regarding trial and settlement based upon the status of the case at the time the question is raised. Sometimes the attorney will leave the decision up to you as there is no clear cut choice; other times the attorneys will have a definite opinion and may attempt to persuade you one way or the other because the choice is clear. While you can and should listen carefully to your attorney-that is why you hired one-the choice is still yours. Any attorney that represents plaintiffs regularly can tell stories of clients that settled against the advice of counsel for far to little or tried cases against their attorney's advice only find out they should have accepted the settlement offer instead. The choice is yours, but choose wisely as this is your only case whereas your attorney will have others.
